The Supreme Court in several of its ruling concerning workers who misconducted themselves said that the worker can be summarily dismissed even without being told about the misconduct, so long as the worker misconducted himself or herself.
When a worker is overpaid his salary or wages and he did not report to his employer about the overpayment, used the money and his employer have to call and inform him that he was overpaid it amounts to stealing.
A worker who is caught stealing is summarily dismissed and on that too the Supreme Court is clear on that.
The other one a Managing Director varying the punishment that a disciplinary committee gave to a worker who faced a disciplinary proceedings.
The Supreme Court is clear on that and ordered the employer to reinstate the worker or pay him redundancy benefits, including other fines that the court might find appropriate.
Those are the only two misconducts that I want to write about.
The Chief Justice is an employee of the state just like any other employee and is subject to disciplinary procedures set up for judges in the Supreme Court in accordance with Article 146 of Ghana's 1992 Constitution.
