A excellently-written piece of legal education. I hope most Ghanaians will take note of this. Ghanaian legal system, however, is very different from the American version. The Ghanaian legal system is a direct copy of the British Legal system which is based on Roman Law. With the exception of our Customary Law, the two systems are almost the same. The American system was also based on the British system, until after the Declaration Of Independence from the British. A lot of changes and modifications were made by the Founding Fathers of the USA, and this is where our Ghanaian system differs from the American system. In my candid opinion, a Will and Testament written in the USA by a Ghanaian who has attained a full American citizenship will not be acceptable by our Ghanaian courts. I am not sure, however, of a Ghanaian with a Dual Ghana-American citizenship. Same thing applies to a Ghanaian who has a full UK Citizenship. It is the Ghana Supreme Court that can give a full interpretation of such matters if a death occurs in a particular family facing such an issue. If Daddy Lumba wrote a Will and had a German citizenship, but did not renounce his Ghanaian citizenship, then the Napoleonic legal system will apply. In this case, ODO BRONI will need a lawyer who has an in-depth knowledge of the Napoleonic system to fight for her in our courts. If DL renounced his German citizenship prior to his demise, Serwaah will be fighting a real battle in our Ghanaian courts for complete access to DL's Ghana properties. I beg to be corrected on all these points I have raised. Our so-called legal luminaries in Ghana, we are waiting for your responses.
