Excellent analysis. The constitutional issues surrounding Article 97(g)(h) are indeed thought-provoking and worthy of deeper reflection. It’s important to balance the rule of law with ensuring a stable and fair parliamentary process. This piece raises critical points that can spark meaningful discussions on the future of our democratic institutions. Well done Sir (Village boy).

I'd like to add that it's a constitutional crisis in the making if an unelected body could literally alter the functioning of an elected body. I am referring specifically to the intervention of Ghana's Supreme Court in the activities of GH
parliament which has ultimately led to indefinite suspension of legislative processes.
The 1992 Constitution needs to be amended to cater for this crisis and many others that overtime, we have realized requires constitutional amendments.

I don't see any problem with article 97(g) (h) of the 1992 constitution, in the wisdom of the framers of the constitution, for example if the people voted for a candidate as an independent candidate to represent them in a constituency n the candidates later decides to join a political party then that candidate has automatically abandoned his constituents n has denied them representation, that's why his seat must be declared vacant, this makes sense in the wisdom of the framers of the Constitution because the people voted for u as an independent candidate n not as that particular party candidate.

Why is no one talking about Article 99, where issues on vacant seats in Parliament first go to the High Court, if not resolved, then Appeal Court and may continue to Supreme Court?
We should be honest with ourselves as Ghanaians and respect the word "TRUTH".
Thanks

I for one will say that we're suffering in this country because of 3 particular groups. Politicians, Lawyers and Journalists. Politicians come to convince us in the name of developing us and when elected they abandon us. Judges and lawyers who should act as good arbitrators rather allow sentimentality to override their decisions. Some journalists instead of telling us the truth decide on favoritism. We have a bigger problem to ourselves
