The Judge’s shameful rejection of an extract is truly a travesty. If you lose a receipt and can show a photo you took of it with your phone, the store will accept it as valid. The most important point in the ruling is that Lumba’s Family cannot deny Akosua Serwah the right to call herself a wife of the late Musician. Had they recognised her even 10%, there would have been peace. The rejected and shamed her but it has now been made clear that she too is a wife, 50%.

Don't blame the Judge, blame Serwaa's incompetent loud mouth lawyer. Someone us posted here Ghanaweb that Serwaa would need a certified copy of her German marriage to produce to the Ghana court to support her claim. That lawyer could have asked some Ghanaians resident in Germany to obtain a certified copy of the marriage record and sent to him, but he failed to do so. The document that the lawyer presented to the Ghana court is not certified and hence can't be admitted into evidence. Without proof of a marriage in Germany, the Judge was left to make a ruling that amounted to a compromise. The two ladies should accept that ruling and move on.

The only way a court will allow a foreign marriage record to be entered into evidence at trial is if that document is certified by the foreign office responsible for certifying marriage records. Marriage documents are always available for issuing to the parties or any person requesting copies, and those copies always have to be certified if a party intends to introduce that document in a court proceeding.
