Under our bigamy laws, "Anyone who knowingly facilitates a bigamous marriage, including the second spouse if they were aware of the existing marriage, can be charged as an accomplice and face the same penalties as the person committing bigamy." The key point here is if they can prove Odo Broni was aware of DL marriage to Akosua or should have been aware, and still legally married DL , she could be charged. If Odo didn't legally marry DL, then there is no issue.

Since neither Lumba nor Serwaa filed for a dissolution of marriage at the time of his death, no length of separation can can act as a dissolution of their marriage. And for the lawyer who is making stupid claims that Broni could be charged with bigamy, one wonders whether he actually obtained a law degree. There's no evidence that Broni, at the time she married Lumba in a traditional wedding, was also married to someone else in a civil marriage. The only person that can be charged with bigamy is the person who was married in a civil wedding and, without obtaining a divorce, proceeded to enter into a second marriage. How then can Broni be charged with bigamy since she never entered into a civil marriage and a customary marriage without first obtaining a dissolution of the civil marriage?

Well, an instruction isn't a will, for the lawyers for the estate would have filed that will in probate court by now if one existed. Furthermore, if a will even exists, the division of assets will be determined by the marital laws of Germany regarding what a spouse is entitled to upon the death of another spouse. In some jurisdictions, spouses can elect to take against the will if they're disinherited or if the portion assign to them if not done in satisfaction of the law. The lesson to be learned by all here is that one should always consult with competent legal counsel when deciding to enter into another marriage when the one is already in a civil marriage, particularly civil marriages carried out in other countries. One should always look before leaping into anything. And looking calls for legal guidance when the one has assets that can spell headaches for survivors if wrong steps are taken. My wish is the both camps in this Lumba case come to a compromise, for that is what will serve both sides best. And compromise calls for understanding the laws as well as coming to the realization that common sense should not be drowned by the law. This case will make a good text book case for Ghana law schools, the collusion between a foreign civil marriage and a domestic customary marriage.

Akosua Serwaa declared her intention to divorce her husband by returning the traditional drinks to the family which per our custom signifies the dissolution of the marriage. Based on that tradition divorce orchestrated by Akosua Serwaa, Lumba decided to have Odo Broni as his partner to care for him . Ghanaians must leave Lumba to rest in peace. He was an icon and does not deserve this treatment.

Criminal charge of bigamy is usually only brought against the person who was still in civil law and then enters into any additional marriages without first obtaining a dissolution of marriage in the civil marriage. In the case of persons like Broni who supposedly were not engaged in multiple marriages, the courts will simply consider her traditional marriage as null and void since she was not in a an active civil marriage at the time she entered into the traditional marriage with Lumba. The bigamy law is intended to punish the person who was engaged in a civil marriage and, without first obtaining a dissolution of that civil marriage, proceeded to enter into another marriage. Bigamy in Ghana does not apply where the person enters into as many customary marriages as they choose to get into.

Seperation of 17 years,the letters sent by Serwa’s lawyers, the drinks sent to DL family and the subsequent reply by DL through his lawyers made their marriage dissolve by law either in Ghana or Germany. Since DL was sick and can’t travel and the intent of both parties to dissolve the marriage was clearly defined. Serwa will lose this case, Traditionally the marriage is no more and they’ve been living separate lives. What makes Serwa the wife, been a wife doesn’t mean signing a paper and abundand your responsibility as a wife until payday. Since when have the German marital laws been changed to provide that when a party is sick and unable to travel, that constitute is an excuse to end the marriage? While some are faulting Serwaa for not officially filing in court to end the marriage when Lumba was alive, why not also question Lumba's reason for not filing in a court in Ghana to end that marriage if he had knowledge from for quite some time that Serwaa was seeking an end to marriage? If you agree that civil marriages in Germany can only be dissolved through the courts, and that there never was any order of dissolution of marriage entered by any court regarding their marriage, why would Serwaa not be a legal spouse at the time of Lumba's death? Sending drinks to one's family means nothing when the the parties are in a civil marriage until a court of law has entered a final order of dissolution of marriage. Nor do any number of years of separation have any effect on the marriage if there never was any court filing to end the marriage. The issues that you raise are only meaningful when addressing the court on why one is seeking an end to the marriage.

Even if there was an intention of the parties to dissolve their marriage, the fact that no formal filing in court was carried out and no final order of dissolution of marriage was ever entered by a court, the parties in the civil marriage were full-fledged spouses at the time of the death of Lumba, leaving the surviving spouse, Serwaa, with full marital rights. Even if a dissolution of marriage was filed in court and then Lumba died before the parties could have a hearing, Serwaa still remained the surviving spouse with her full marital rights. Without a an final order of dissolution of marriage entered by a Judge, that civil marriage remain in full force, and the only a Probate Court can then handle the rights of the all persons with interest in the estate, including the surviving spouse and children. The rights of the survivors will then be depend on whether a will exists or Lumba died without a will.

The parties in a civil marriage can be separated for decades, but if no final order of dissolution is entered by a court, that marriage of the separated couple has the same legal force as as civil-wedded couple still residing together. One would think that in this day and age when Ghana has the ability to document events, that customary marriages will also be be documented to preserve the time of marriage as well as the the time when those marriages terminate. There ought to be a section in the civil marriage offices that will also deal with the registration of traditional marriages.

Dear Kumasi lawyer, No, Odo broni cannot be charged with bigamy, but the deceased man, Lumba could have been guilty of bigamy. Bigamy is the crime of a person who is already married entering into a second marriage. As the man has passed away, he committed bigamy, but the legal proceedings are no longer relevant, he is dead and nobody can be charged with bigamy. The woman Odo broni could, however, have faced charges as an accomplice or for aiding and abetting bigamy if Lumba were still alive. But bigamy charges against Lumba if he was alive is still contestable if it can be proven that Akosua Serwaa and Lumba had nothing to do as husband and wife for 16 years.

On the other hand it can be proven that Lumba did not hide Odo Broni as his partner/wife He actually stood on public platforms and showed publicly his love for Broni. Moreso when Akosua Serwaaa deserted Lumba for 16years, making nonsensense of Lumba's conjugal rights (not sexual by the way) but the right to a spouse's company and companionship as well as the right to live together. Accordingly Akosua Serwaa repudiated her marital duties even when Lumba was sick frail and dying. SO THERE WAS NO MARRIAGE BETWEEN SERWAA AND LUMBA AND NO WIFE IN THE EYES OF THE PUBLIC FOR 16YEARS THAT LUMBA LIVED WHICH IS ACCEPTABLE BY LAW

Without a formal order in a court dissolving the marriage, the parties were still man and wife at the time of Lumba's death regardless how long they had been separated.

From reports from others about the marriages of Lumba, if Serwaa and Lumba had been in a customary marriage prior to their civil marriage in Germany, then that civil marriage will likely be viewed by a court being null and void. For one can't enter into a civil marriage without first ending the customary marriage they had entered into. The fact that Serwaa eventually sent drinks to Ghana to have the customary marriage ended still may have no effect if that had not been done before the civil marriage was entered into. Broni's lawyers should look into the when, if there ever was one, the customary marriage and civil marriage between Serwaa and Lumba took place. Those dates can determine which of the two women had a valid marriage at the time of Lumba's death. Serwaa may be waving a German civil marriage to prove that she's the legally married surviving spouse, but a deeper investigation into a possible prior customary marriage before entering to the civil marriage could derail her case. If at the time serwaa sent her drinks to dissolve her customary marriage she still was in her civil marriage, then it follows that she never obtained an end to her customary marriage before entering into her civil marriage. This is a messed up case, given that Ghana's customary marriages are never recorded to provide official dates of marriage and date that customary performances took place to end those customary marriages.

You have to always consider the legalities in marriage not your emotions. This is a good case study not about Akosua Serwaa or Odo broni.

If Daddy Lumba married Odo Broni in the traditional way, why change her with bigamy . Our traditional marriage is an acceptable and recognized marriage in the country. Akosua Serwaa declared her intention to divorce her husband by returning the traditional drinks to the family which per our custom signifies the dissolution of the marriage. Based on that tradition divorce orchestrated by Akosua Serwaa, Lumba decided to have Odo Broni as his partner to care for him . Ghanaians must leave Lumba to rest in peace. He was an icon and does not deserve this treatment.
