The appointment of the IGP under Article 202(1) is different from the appointment of a public servant under Article 195 of the Constitution. There is a clear distinction in the modes of appointment.
Article 202(1) provides as follows;
“The Inspector –General of Police shall be appointed by the President acting in consultation with the Council of State.”
Article 195 provides as follows;
“195. APPOINTMENTS, ETC. OF PUBLIC OFFICERS
(1) Subject to the provisions of this Constitution, the power to appoint persons to hold or to act in the public services shall vest in the President, acting in accordance with the advice of the governing council of the services concerned given in consultation with the Public Services Commission”
These provisions clearly show that there is a distinction in the appointment procedure for the IGP. The IGP’s appointment is by the President, in consultation with the Council of State and not by the President in consultation with Public Services Commission.
Even though the IGP is a public servant and appointed from among the commissioners, by the very nature and procedure of appointment into that office under the Constitution, that IGP ceases to be a member of the public service as contemplated under Article 191 and is placed in a special category of its own. Consequently, the removal procedure under Article 191 (b) cannot apply to such office holder(IGP).
In this wise, the jurisdiction of the Supreme Court in the IMANI case has not been properly invoked because, Article 191(b) of the 1992 Constitution, on which IMANI based their case is applicable to career Public Servants, properly so called.
Pursuant to Articles 202 of the 1992 Constitution, the IGP belong to a special category of Public Servants. The IGP is unlike a regular Public Servant whose appointment is vested in the President, acting in accordance with the advice of the Governing Council of the Institution concerned, given in consultation with the Public Services Commission.
The Constitution made a deliberate distinction between the appointment of members of the Public Service simpliciter under Article 195 which is made in consultation with the Public Services Commission and those special appointments made by the President, which includes the one under Article 202, in consultation with the Council of State, and maintain that the sanctity of this distinction must be protected.
The IGP is appointed by the President, in consultation with the Council of State. The case of Theophilus Donkor v The Attorney-General Writ No. J1/08/2017 distinguishes between the regular career Public Servants and Public Servants of a special category like the IGP. By this distinction the IGP is not a member of the Public Service as envisaged under Article 195(1) of the Constitution and is therefore not subject to Article 191 of the Constitution. There is therefore no need to provide a “just cause” under Article 191(b) for his removal. The IGP can be removed at anytime at the pleasure of a sitting President.
Further to this, the IGP, once appointed, now attains the pinnacle of public service particularly in the Police Service and becomes a non-career public office holder. It therefore follows that the removal of the IGP cannot be the same as those members of the public service which is anticipated under Article 191 (b).
It is also important to note that, although the President, by virtue of Article 297 of the 1992 Constitution, has the power to appoint and terminate the appointments of the IGP, this power is not absolute. The Constitution, per Article 296(b) limits this power by providing that it should not be exercised arbitrarily, capriciously or in a biased manner either by resentment, prejudice or personal dislike and shall be in accordance with due process of law. Article 296(a) further provides that the discretionary power shall be deemed to imply a duty to be fair and candid.
Article 297 of the 1992 Constitution provides;
“In this Constitution and in any other law -
(a) the power to appoint a person to hold or to act in an office in the public service shall include the power to confirm appointments, to exercise disciplinary control over persons holding or acting in any such office and to remove the persons from office;
(b) where a power is conferred or a duty is imposed, the power may be exercised and the duty shall be performed, from time to time, as occasion requires;
(c) where a power is given to a person or authority to do or enforce the doing of an act or a thing, all such powers shall be deemed to be also given as are necessary to enable that person or authority to do or enforce the doing of the act of thing;
(d) where a power is conferred to make any constitutional or statutory instrument, regulation or rule or pass any resolution or give any direction, the power shall be construed as including the power, exercisable in the same manner, to amend or to revoke the constitutional or statutory instrument, regulation, rules or resolution or direction as the case may be;
(e) words importing male persons include female persons and corporations.
(f) words in the singular include the plural, and words in the plural include the singular;
(g) where a word is defined, other parts of speech and tenses of that word have corresponding meanings;
(h) words directing or empowering a public officer to do any act or thing, or otherwise applying to him by the designation of his office, include his successors in office and all his deputies and all other assistants;
(i) words directing or empowering a Minister of State to do an act or a thing, or otherwise applying to him by the designation of his office, include a person acting for him, or if the office is vacant, a person designated to act in that office by or under the authority of an Act of Parliament and also his successors in office and all his deputies or other assistants;
(j) where a power is conferred or a duty is imposed on the holder of an office as such, the power may be exercised and the duty shall be performed by the person for the time being charged with the performance of the functions of that office.”
Further, Article 296 of the 1992 Constitution provides as follows;
“Where in this Constitution or in any other law discretionary power is vested in any person or authority -
(a) that discretionary power shall be deemed to imply a duty to be fair and candid;
(b) the exercise of the discretionary power shall not be arbitrary, capricious or biased wither by resentment, prejudice or personal dislike and shall be in accordance with due process of law; and
(c) where the person or authority is not a judge or other judicial officer, there shall be published by constitutional instrument or statutory instrument, regulations that are not inconsistent with the provisions of this Constitution or that other law to govern the exercise of the discretionary power.”
In conclusion, it is important to note that the pendency of the IMANI case before the Supreme court does not in anyway injunct the appointing authority and for that matter the current or incoming president from removing the IGP if he so wishes in line with article 297 and 296 of the 1992 constitution.
A contempt action cannot and would not lie against any appointing authority, i.e. current or incoming president who removes the IGP upon assumption of office. Article 57(5) of the 1992 Constitution provides as follows: “The President shall not, while in office as President, be personally liable to any civil or criminal proceedings in court”
Dampare is the sponsor of this Supreme Court case as it is now being used by his paid so-called think tanks to fight against his removal.
The reset agenda by the NDC which Police officers were in support of and voted for has no room for Dampare and his failed vicious leadership style. Majority of Police Personnel wants him sacked by His Excellency John Dramani Mahama upon assumption of office as President of the Republic of Ghana on 7th January,2025.
Why are you fighting for him, Mr. Bentil? Do yo know that 90% of Police Officers see him as wicked and vindictive. Dampare must go!
