In a democratic state, what Ayariga said is perfectly right. No institution can come out to arbitrary arrest people when there is no law existing in effect.
The onus is on Bank of Ghana to come clean to provide information on any existing law that was breached by the arrested people.
We all use emotions to think most of the time, but not thinking critically.

It protects the integrity, value, and physical condition of the national currency and guards against counterfeiting and depreciation.
1. Key Objectives and Scope
- Legal Tender Protection: Regulates coins and notes issued by the Bank of Ghana. Prevention of Depreciation: Prohibits acts designed to diminish the value or public trust in the currency.
- Control of Circulation: Governs the import/export of currency and restricts unauthorized foreign currencies from circulating freely.
2. Major Prohibitions and Offences
A. Commercial and Pricing Restrictions (Sections 1–4)
- Discounting Currency (Section 1): It is illegal to buy, sell, or accept current coins or notes at a value lower than their face value.
- Over-valuing Silver Coins
- (Section 2): Buying or accepting current silver coins for an amount exceeding their face value is prohibited.
- Varying Prices (Section 3): Sellers cannot adjust, increase, or decrease product prices based on whether a customer pays with notes, standard coins, or silver coins.
- Refusal of Legal Tender (Section 4): Businesses or individuals cannot refuse to sell ordinary goods to someone offering valid legal tender notes or coins.
B. Defacing, Altering, and Damaging Currency (Sections 9 & General Regulations)
The Bank of Ghana frequently references Act 242 to caution the public against destroying or disrespecting currency notes and coins.
Prohibited actions include:
- Physical Damage: Writing on, staining, crumpling, tearing, or cutting banknotes.
- Spraying or Stepping on Money: Cultural practices like spraying cash at events or stepping/dancing on currency notes.
- Coin Tampering: Gilding, silvering, coloring, washing, filing, clipping, or altering the physical weight or appearance of coins, as well as possessing metal scrapings/filings from coins.
C. Counterfeiting and Forgery (Sections 6–20)
Counterfeiting Coins (Section 6):
- Falsely making or counterfeiting current coins is treated as a second-degree felony, even if the coin is unfinished.
Forging Banknotes (Section 18):
Printing, possessing, or "uttering" (passing off) forged notes knowing they are fake carries severe felony charges.
Possession of Tools: Making, mending, buying, selling, or possessing instruments or special paper intended for counterfeiting coins or notes is heavily penalized (often classified as first-degree felonies).
D. Import, Export, and Foreign Currency Controls (Sections 23–26)
= Restricts the unauthorized physical importation or exportation of specified local and foreign notes or coins.
- Prohibits the general circulation of unauthorized foreign coins or notes as legal tender within the Republic.
3. Penalties
Violations of the Currency Act carry strict penalties depending on the severity of the offense:
Commercial/Pricing Breaches: Historically carried terms of imprisonment or fines (with subsequent statutory amendments updating penalties to modern fine units/terms of imprisonment).
