Spintex workers win appeal against management

Accra, March 12, GNA - An Appeal Court in Accra has declared that the purported termination of 150 workers from Spintex, was null and void and of no effect.

By unanimous decision, the court, presided over by Mr. Justice K. Omari Sasu, on Friday stated that, "the appeal has no merit and ought to fail" and therefore, dismissed it.

The court, with Mr. Justice S.Y. Anim an Appeal Court Judge, and Mrs. Justice G. Kusi-Appouh a High Court Judge with additional responsibility as an Appeal Court Judge, as panel members, affirmed the judgement of the lower court that determined the case earlier. The Appeal Court also awarded a cost of 48 million cedis against the management of Spintex.

The Appellant, Spintex, had gone to the Court of Appeal to seek leave in order to rescind a judgement by a lower court in favour of the Respondent, Workers.

The Appellant purported to declare the Respondent redundant, and succeeded in paying some off.

Respondent then went to a lower court and won its case against management, but management thought it had a good case and therefore, appealed against the lower court's decision, but lost the appeal. Counsel for the Appellant was Mr. Felix Aboagye, while Mr. Appiah Kubby appeared for the Respondent.
