Tobinco withdraws suit against FDA

The embattled pharmaceutical company, Tobinco, has decided to withdraw a suit against the Food and Drugs Authority and has rather opted for an out of court settlement.

Tobinco Pharmaceutical Company limited earlier on applied for an interim injunction restraining the FDA from further destroying its imported products.

This followed the FDA’s labeling of some drugs imported by the company as fake and dangerous.

The FDA stated that it was unfazed by the action of Tobinco stating that it was committed to ensuring that fake drugs are not imported into the country.

But in a sharp U-turn by the company, its lawyer, Fredrick Asamoah told Radio XYZ's Strict Proof program on Monday that the case would be withdrawn from court for the two parties to have an amicable settlement.

According to him, the court action was to prevent the FDA from consistent destruction of their drugs.

He insisted that the drugs imported into the country by Tobinco are not fake, adding that tests must conducted by the FDA before they are destroyed.

He added that it was prudent that the case is settled amicably to prevent an escalation of the matter in the media.
