The High Court in Accra has dismissed another application by Nana Kwame Bediako seeking to stop Cola Holdings Ltd from enforcing a $14.9 million judgment against him.

The Commercial Division 3 of the High Court, presided over by Justice Awuah Dabanka-Bekoe, dismissed the application on Monday, July 27, 2026, and awarded GH¢20,000 in costs against Nana Kwame Bediako in favour of Cola Holdings Ltd.

The application, filed by his lawyer, Bobby Banson, sought an injunction to prevent Cola Holdings from enforcing a judgment obtained against Nana Kwame Bediako in an English High Court.

The UK judgment has already been registered in Ghana, meaning Cola Holdings can take steps to enforce it locally.

Nana Kwame Bediako had filed an appeal challenging an earlier decision of the High Court in Accra which refused to cancel the registration of the English judgment.

His latest application was therefore intended to stop Cola Holdings from enforcing the judgment until his appeal is determined.

How the case started

The dispute relates to a loan involving Kensington Residential Partners 1 Ltd, a company in which Nana Kwame Bediako and Azad Cola hold shares.

Cola Holdings Ltd, a UK-registered company, had guaranteed a loan obtained from the International Finance Corporation (IFC).

After the loan was not repaid, the IFC called on Cola Holdings to settle the outstanding amount as guarantor. Cola Holdings subsequently paid the amount and took over the IFC’s rights to recover the debt.

Cola Holdings then sought repayment from Nana Kwame Bediako based on a Deed of Indemnity he had signed concerning his share of the loan.

When he did not repay the amount, Cola Holdings took the matter to the High Court in London and obtained judgment against him personally.

The London court ordered Nana Kwame Bediako to pay $14,928,314.70, together with continuing interest of $3,271.96 per day from January 23, 2025, at an annual rate of 8%.

The judgment was subsequently registered at the High Court in Accra on May 20, 2025.

Nana Kwame Bediako later applied to the High Court in Accra to set aside the registration of the English judgment.

However, the application was dismissed by the Commercial Division 3 on November 27, 2025.

He subsequently appealed that decision.

His latest application sought to prevent Cola Holdings from enforcing the judgment while the appeal is pending.

The High Court, however, dismissed the application and ordered Nana Kwame Bediako to pay GH¢20,000 in costs to Cola Holdings.

The latest ruling means the UK judgment remains registered in Ghana while Nana Kwame Bediako’s appeal continues.
