DRIP Contract Dispute: J A Plant Pool challenges Attorney General's lawsuit

J A Plant Pool (GH) Limited (JAPP) and its Executive Chairman, Dr Joseph Siaw Agyepong, have rejected claims by the Attorney General that the company owes the Government of Ghana US$2 million under the District Road Improvement Programme (DRIP).

In a statement issued on June 2, 2026, the company said it would challenge the legal action and defend itself in court.

The statement follows a suit filed by the Attorney General seeking to recover the amount, which the state claims is owed under a contract executed under the DRIP initiative.

JAPP said it was concerned that details of the suit were widely circulated in the media before the company and Dr Joseph Siaw Agyepong were formally served.

According to the company, the publicity surrounding the case has caused damage to its reputation, that of the Jospong Group of Companies and its business partners.

“JAPP and Dr Joseph Siaw Agyepong categorically deny any indebtedness to the Government of Ghana or any of her agencies arising from the Contract dated 12th February 2024, executed pursuant to the DRIP program,” the statement said.

The company explained that the contract followed approval by the Public Procurement Authority (PPA) on January 10, 2024, for the government to procure machinery and equipment from JAPP at a cost of US$178.7 million.

It noted that both the PPA approval and the subsequent contract reflected the same amount as the agreed contract sum.

JAPP further stated that it had fully delivered all the machines and equipment required under the agreement and that all payments were made according to the terms of the contract.

“As the Attorney General knows, the Contract has since been fully performed with JA Plant Pool duly supplying all machines and equipment to the Government of Ghana. All payments required to be made under the Contract have been made in strict accordance with the terms of the Contract,” the statement added.

The company described the Attorney General’s action as being in bad faith and said it had instructed its lawyers to challenge the suit.

“JA Plant Pool and Dr Joseph Siaw Agyepong consider the suit filed by the Attorney General to be in bad faith and have accordingly instructed their lawyers to challenge the suit and ensure its dismissal,” the statement said.

JAPP also called on the public to disregard any suggestion of wrongdoing arising from the case and reaffirmed its commitment to transparency, accountability and lawful business practices.

“JAPP and Dr Joseph Siaw Agyepong urge the public to disregard the imputations of wrongdoing conveyed by the wide publication of the suit by the Attorney-General in the media,” the statement noted.
