Ghanaian lawyer, Kwasi Fokuo Benyin, has expressed concern over delays in the release of a written court order following the remand of Bono Regional Chairman of the New Patriotic Party (NPP), Kwame Baffoe, describing the situation as highly unusual and potentially harmful to the legal process.
Speaking on the Asaase Breakfast Show on Tuesday, May 19 2026, Fokuo Benyin said five days after the court ruling, the official order had still not been signed or made available to Abronye’s legal team.
According to him, the delay has effectively prevented the defence from filing an appeal or seeking further legal intervention at a higher court.
“That is a very serious anomaly,” he said.
Benyin explained that under normal legal procedures, a written court order is required before lawyers can challenge a ruling through the appellate system.
“The appellate system exists to correct judicial errors, but you cannot activate it without the order,” he added.
He warned that prolonged delays in issuing such documents could undermine due process and create serious difficulties for accused persons, especially in criminal cases where time is critical.
According to the lawyer, withholding the order for several days risks causing what he described as “substantial injustice” and could weaken confidence in the fairness of the judicial process.
Benyin further stressed that regardless of whether a judge believes a ruling is legally sound, the written order must still be released promptly to allow affected parties the opportunity to seek review through the appropriate legal channels.
