Private legal practitioner and petitioner, Justice Abdulai, has called for the Minority Leader in Parliament, Alexander Afenyo-Markin, to be cited for contempt over comments he made against a circuit court judge handling the case involving New Patriotic Party (NPP) communicator Kwame Baffoe also known as Abronye DC.
Speaking to GHOne TV in a video shared on X on May 19, 2026, Justice Abdulai argued that the Effutu MP’s remarks against the judge were inappropriate and amounted to contempt of court.
According to him, the Minority Leader, who is also a senior lawyer, is fully aware that parliamentary immunity cannot shield him from contempt proceedings.
“The Minority Leader is very much aware of this. The Minority Leader is a senior lawyer. He knows very well that contempt of court is part of the process and that he cannot rely on his parliamentary immunity,” he stated.
Justice Abdulai further questioned the relevance of parliamentary immunity in modern democratic governance, insisting that such protections no longer serve the purpose for which they were originally created.
“Historically, parliamentary immunity was designed to protect members of parliament from abuse by the executive. Today, we no longer have that kind of situation because we have systems in place to check abuses by the executive against parliamentarians,” he explained.
He maintained that if a legislator uses parliamentary immunity as a shield to attack the judiciary, the courts must assert their authority.
“And so, if a parliamentarian relies on his immunity to abuse the court, I would insist that the appropriate authorities in this particular case, unfortunately it can only be the court, invoke its authority to cite him for contempt. And I would strongly urge that to happen,” he added.
Justice Abdulai argued that public officials must respect state institutions, stressing that he could not publicly insult the Minority Leader over his parliamentary responsibilities without consequences.
His comments follow a press conference held by Afenyo-Markin on May 17, 2026, during which he strongly criticised a circuit court judge identified as “Niger” for refusing to grant bail to Abronye DC.
The Minority Leader openly declared that he had no respect for the judge and questioned his competence and legal credentials.
“That judge has no respect for his own judicial oath. I don't think he read the law. That circuit court judge called Niger, I have no respect for him,” Afenyo-Markin said.
He further vowed to continue criticising the judge until he “upholds the law.”
“I pray that he summons me for contempt. I will continue to disrespect him until he upholds the law. He’s gone beyond his judicial function, and it is not his first time,” he stated.
The Effutu legislator also called on the Chief Justice, Justice Paul Baffoe-Bonnie, to intervene in the matter, arguing that failure to act could damage the Chief Justice’s legacy.
