Legal practitioner Martin Kpebu has revisited the Gregory Afoko murder trial while discussing prosecutorial conduct in Ghana.

The popular lawyer argued that Ghana must continue reviewing how prosecutorial powers are exercised in high-profile criminal cases.

His comments came amid public debate surrounding the GH¢49 million National Signals Bureau trial involving former NSB Director-General Kwabena Adu-Boahene and his wife.

The latest hearing saw prosecution witness Mildred Donkor tell the court that pre-signed cheque books belonging to companies linked to the accused persons were allegedly used for withdrawals.

While discussing broader legal issues, Martin Kpebu referred to the Gregory Afoko case and criticised the decision to discontinue and restart the prosecution after the initial proceedings neared judgment.

“They cancelled the case and restarted it all over again,” he said.

According to him, the retrial eventually failed to secure a conviction.

Martin Kpebu also recalled legal disputes surrounding bail decisions in the case, arguing that some prosecutorial actions raised concerns about fairness and abuse of process.

He further spoke about the “Table Number Four” Supreme Court decision, which clarified that constitutional limits on detention include weekends and public holidays.

“When you arrest somebody, you must ensure constitutional protections are respected,” he stated.

Martin Kpebu maintained that reforms are needed to prevent abuse and strengthen public confidence in the justice system.
