The Special Prosecutor, Kissi Agyebeng, has clarified that his relationship with the Attorney General (AG), Dr Dominic Akuritinga Ayine, remains professional and cooperative despite media speculation suggesting otherwise.
Speaking at a press conference on Thursday, October 30, 2025, he stressed that there is "No tension or misunderstanding between the two institutions regarding the ongoing extradition and prosecution processes involving former finance minister Ken Ofori-Atta.

He said both the OSP and the Attorney General’s office are working hand in hand to ensure the case is handled efficiently and in accordance with the law.
He dismissed rumours of friction, describing them as baseless and misleading and emphasised that their focus remains on ensuring justice and accountability.
Kissi Agyebeng assured the public that the OSP and the Attorney General’s office continue to collaborate effectively on all ongoing investigations, including the Ofori-Atta case and remain focused on delivering justice without unnecessary distractions.

"It’s unfortunate that there’s been talk about dockets, and we’ve refused to give the docket and all. That is beside the point; that is not the issue at all. The issue is that you need to get it right the first time; you don’t keep going back and forth", he noted.
He reaffirmed that the two offices share a mutual commitment to due process and will continue to collaborate closely on all ongoing cases.
Ofori-Atta was first identified by the OSP in January 2025 as a suspect in several corruption-related cases, including alleged irregularities in contracts with Strategic Mobilisation Ghana Limited (SML), expenditures linked to the National Cathedral project, and issues in health and tax refund operations.
He was declared a fugitive in February 2025 after failing to honour multiple OSP summonses.
His lawyers later requested that his name be removed from the wanted list, promising he would return. However, after he again failed to appear before the OSP in June 2025, his fugitive status was reinstated and the OSP indicated it would pursue extradition while maintaining the Interpol Red Notice.
Ten months after being first declared a fugitive, Ofori-Atta has neither been arrested in the United States nor voluntarily returned to Ghana.
