Petition against Justice Ackaah-Boafo's nomination to the SC 'frivolous' - Ahiafor

The Appointments Committee of Parliament has described a petition filed against Supreme Court nominee Justice Kweku T Ackaah-Boafo as “frivolous, worthless, and an abuse of power.”

Addressing the committee during the vetting of Justice Ackah-Boafo, the Chairman, Bernard Ahiafor, stated that after reviewing the contents of the petition and the allegations leveled against the nominee, the committee dismissed the claims as baseless in both law and fact.

“Honorable members, Article 127(3) of the 1992 constitution of the Republic of Ghana says that a justice of the Superior Court or any other person exercising judicial power, shall not be liable to any action or suit for any act or omission by him in the exercise of the judicial power.

“The complaint against the nominee is about the exercise of judicial power in conducting the matter leading to the judgment under reference. The committee, this morning, ruled that the petition is frivolous, facetious, worthless, unmeritorious and it is baseless in law and the facts. A complete abuse of the process,” he said.

Following the committee’s decision, the vetting process of Justice Ackah-Boafo, previously suspended due to the petition, is now back underway for consideration and approval.

Background

The petitioner, international human rights activist, Anthony Kwabena Rau, accused Justice Ackaah-Boafo of unprofessional conduct during previous court proceedings, particularly displaying extreme bias and using inappropriate language, according to Accra-based myjoyonline.com.

Kwabena Rau further cited an incident at the Driver and Vehicle Licensing Authority (DVLA) courts to support his claims.

In his petition, he alleged that the judge 'insulted and attacked' him during a hearing, referring to him as a 'so-called ‘Messiah’ international Human Rights Activist' and questioning his legal right to represent clients in Ghana.

Furthermore, he claimed that the judge’s official written judgment in the case contained personal insults, which Rau interprets as clear evidence of bias and corruption.

“Arrogant, biased, power-drunk, an abuser of human rights (sic) and supportive of corruption,” Rau is quoted as saying by myjoyonline.com.

The report also claimed that Rau, the petitioner, predicted dire consequences should Justice Ackah-Blay be approved by the Appointments Committee, issuing a strong warning against such a decision.

“For me, he will be a disaster at the Supreme Court if approved (sic) for the international and national interest of the republic. These are my reasons to petition the vetting committee not to approve this particular judge,” another quote attributed to him added.
