PDS-ECG Case: Arrested lawyers can sue EOCO, BNI – Tuah-Yeboah insists

Former Deputy Attorney General Alfred Tuah-Yeboah has called on legal practitioners Justice Kwasi Menka-Premoh and Sophia Korkor to take legal action against two state institutions over their arrests, as the probe into the Power Distribution Services (PDS) loss of GH¢850 million continues.

The former CEO of the National Food Buffer Stock Company, Hanan Abdul-Wahab Aludiba, and his wife, Faiza Seidu Wuni, were arrested by security agencies over allegations of involvement in the matter.

Following this, they invited their legal representatives, Justice Kwasi Menka-Premoh and Sophia Korkor, to assist and possibly secure bail for them.

However, the two lawyers were also arrested and later issued a statement confirming that they were detained by the Bureau of National Investigations (BNI) and the Economic and Organised Crime Office (EOCO) while attempting to provide legal representation for their clients.

They said they were accused of dishonestly receiving money linked to an alleged money laundering scheme involving GH¢850 million from an ECG account.

They added that they were not shown any evidence of the alleged amount and were later granted bail of GH¢50 million each.

Reacting to the development, the former Deputy Attorney General said the actions of the security agencies amounted to an abuse of power.

He argued that although the lawyers were part of the investigation, they should have been allowed to discharge their professional duties by representing their clients.

Tuah-Yeboah indicated that the lawyers may decide to sue the BNI and EOCO over their arrests, a move he fully supports.

“They are lawyers who represented their clients and were paid their appropriate legal fees. Aside from the legal fees, that is all I know. So, if you are investigating a lawyer simply because he represented his client and was paid legal fees, that lawyer has every right to say you are abusing your power. And I agree with them. You have actually put them in a situation where people may see them as criminals.

“And let me say that the lawyers involved may want to take legal action because state agencies are paid by the people, and before they subject anybody to such a process, they must be very sure. You do not have to speculate that maybe PDS paid you some money, and because of that you are under arrest. As I said earlier, if we are to go along that tangent, then some of you and I will be arrested by the state because we have represented clients in criminal and civil matters who have also paid us,” he said on Newsfile on JoyNews.
