Kwamohene Floored Again

THE ASHANTI Regional Tribunal has dismissed an appeal filed by the Kwamohene, Nana Amoako Mensah, against an earlier ruling in favour of 85-year-old Francis Boakye Mensah.

The dismissal of the appeal application followed the deponent's affidavit against tbne appeal.

The affidavit sworn to by the deponent Francis Boakye Mensah of Kwamo maintained that Kwamohene's affidavit in support of the appeal does no justice to the integrity, sense of responsibility and competence of an important department of state as the Attorney General's office, as the law office is said to have lost track of the case, whose judgement was given on November 30, 2000, according to Kwamohene's affidavit.

The deponent contended that in the peculiar circumstance, not oly should the application be dismissed, but to discourage frivolous and vexatious applications in the future, the court should order the prosecution of the Kwamohene to serve as a deterrent to the opulent in society who may try to use their influence to prevent justice.

The chairman of the regional tribunal, Justice K. K. Yanney, passed the baton to the Principal State Attorney to take up the matter to prosecute the Kwamohene, if the office of the Attorney General so determines.

The Chronicle in its April 5 edition reported that the Ashanti Regional Tribunal cleared Opanin Francis Boakye Mensah, 85, of three counts of forgery, while his accuser, the Kwamohene, stood accused of forgery, according to evidence before the trial court.

The decision of the tribunal to acquit and discharge the 85-year-old followed insufficient evidence and therefore accepted a submission of no case to answer, thereby reversing the decision of a trial circuit court.
