Businessman and Chief Executive Officer (CEO) of the defunct Menzgold Ghana Limited, Nana Appiah Mensah, has stated that he will exhaust all legal avenues, including petitioning the apex court, to pursue his application for a stay of proceedings in his criminal trial.
He made this known after the Court of Appeal, on Monday, May 19, 2025, dismissed his application filed pending the determination of an appeal challenging a High Court ruling that ordered him to open his defence.
Speaking to the press at the court premises in a video shared by GHOne TV on Facebook, Nana Appiah Mensah, popularly known as NAM 1, who sounded confident and unperturbed by the Court of Appeal’s decision stated that he would consult with his lawyers on the next course of action to be taken in his case.
“It doesn't end here. We still have the Supreme Court, so we will just exercise all our rights enshrined under the Constitution of this beautiful republic and so, I'll confer with my lawyers and then whatever as they so advice, I will proceed,” he said.
The businessman is facing multiple charges, including the sale of gold without a license, fraudulent breach of trust, defrauding by false pretense, and money laundering.
In 2024, the High Court directed NAM 1 to open his defence however, his legal team filed an appeal at the Court of Appeal in an attempt to have the ruling overturned.
The Court of Appeal on Monday, May 19, 2025, was urged by state prosecutors to dismiss the application, arguing that it was an attempt to overreach the powers of the court and failed to demonstrate any exceptional circumstances to justify a stay of proceedings.
A three-member panel of the Court of Appeal, presided over by Justice Suurbaareh and supported by Justices Afia Serwaa Asare-Botwe and Christopher Archer, unanimously dismissed the application.
