HIGH COURT DISMISSES GBA'S APPLICATIONS.

An Accra High Court yesterday dismissed a preliminary application filed by the Ghana Bar Association (GBA) challenging the capacity of Mr T.N. Ward-Brew, an Accra Lawyer for bringing an action against the association.

The court, chaired by Mr Justice A.A. Benin, awarded c100,000 cost against the association and directed that the case should take its normal course.

Mr Ward-Brew had asked the High Court to declare the resolution adopted by the GBA on February 25 calling on Mr Justice I.K. Abban to step down as Chief Justice within 14 days and also condemning the sentence of Mr Kwabena Bonsu, unconstitutional, illegal, null and void.

An affidavit filed on March 13 by Mr Peter Ala Adjetey, a member asked the court to set aside the action by the plaintiff. The affidavit said the court had no jurisdiction to hear the plaintiff's case and that the writ did not disclose any reasonable cause of action.

Mr Justice Benin said the plaintiff instituted the action in his capacity as a member of the legal profession to which all lawyers belong and is governed by statutory provision under the Legal Profession Act of 1960.
