Gary Nimako slams Parliament for hasty declaration of vacant seat in Kpandai

The Director of Legal Affairs of the New Patriotic Party (NPP), Gary Nimako, has expressed reservations over the notification by the Clerk of Parliament regarding a vacant seat in the Kpandai Constituency.

Speaking in an interview on Neat FM and monitored by GhanaWeb on Tuesday, December 9, 2025, he questioned the legality of the action.

According to him, it is questionable considering the fact that the Clerk of Parliament has already been served with an appeal, a stay of execution, and a
Certiorari application.

“Why the haste? I will be very surprised if the letter from Parliament to the Electoral Commission on the declaration of a vacant seat in Kpandai is genuieue.

"The Clerk of Parliament has been served with an appeal, a stay of execution from the High Court, and the Certiorari application seeking to quash the judgment. I am surprised the law is being turned upside down", he remarked.

Gary Nimako continued, “How can a Clerk of Parliament, who has been served with all these, write a letter like this? I am surprised. The Supreme Court bailiff has served the Clerk of Parliament with a bailiff notice. No judge has given the go-ahead.”

The 2024 National Democratic Congress (NDC) parliamentary candidate for Kpandai, Daniel Nsala Wakpal, on December 23, 2024, filed a petition at the court challenging the EC's declaration of Matthew Nyindam as the MP-elect for the constituency.

He alleged that the results of the parliamentary elections, as declared by the EC, were invalid due to some irregularities and inconsistencies contained in some of the pink sheets.

After examining the evidence, the court agreed with the petitioner, ruling that the level of non-compliance materially affected the outcome of the poll.

It subsequently ordered the EC to organise a fresh parliamentary election in the constituency to determine the rightful winner.

Following the ruling, lawyers for the defendant filed for a stay of execution pending the determination of an appeal.

Meanwhile, the embattled New Patriotic Party (NPP) candidate at the centre of the election dispute, Matthew Nyindam, said he will consult both his party leadership and constituents before deciding whether to contest the court-ordered parliamentary re-run in the constituency.
