Failure to extradite Ofori-Atta could encourage politicians to flee justice – Inusah Fuseini

Private legal practitioner and former Tamale Central Member of Parliament, Inusah Fuseini, has raised concerns over the political and legal consequences if former Finance Minister Ken Ofori-Atta and Ernest Darko Akore, a former Chef de Cabinet (Technical Advisor) at the Finance Ministry, are not extradited to Ghana.

According to him, failure to bring the two back could set a dangerous precedent for accountability in the country.

“Politically, failure to bring him back could deepen impunity. Ken Ofori-Atta and Akore are not alone; they worked alongside the cabinet. After losing elections, why would they flee unless to avoid accountability? If we fail to bring him, it could set a precedent for future politicians with questions to answer to evade justice by leaving the country,” he said in an interview on Accra-based Woezor TV.

The former lawmaker, however, emphasised that extradition is not a presumption of guilt.

“We are not saying he’s guilty. He will have the opportunity to answer questions related to his involvement with the SMF before the Attorney-General, the Office of the Special Prosecutor, or the courts, which have a duty to be fair in all matters,” he remarked.

Meanwhile, the Attorney General and Minister of Justice, Dr Dominic Akuritinga Ayine, confirmed that formal steps had been taken to request the extradition of Ken Ofori-Atta and Akore from the United States.

“On December 10, 2025, my office transmitted the complete request to the Minister of Foreign Affairs for onward transmission to the competent authorities in the United States, namely the Department of Justice,” Dr Ayine said.

He continued, “It is now up to the American judicial authorities to determine if a sufficient basis exists to extradite the two accused to Ghana to stand trial.”

Dr Ayine noted that Ofori-Atta has engaged top lawyers who may challenge the extradition but assured that he would receive a fair trial in accordance with the 1992 Constitution.

“This is his home. He should just join the next available flight and come back. Under my watch, he will not be treated unfairly,” he added.

Ofori-Atta, along with accomplices including Emmanuel Kofi Nti and Ammishaddai Owusu-Amoah, former Commissioner-General of the Ghana Revenue Authority (GRA), faces 78 charges involving financial loss to the state, abuse of office, illegal procurement, and using public office for private gain.
