Court orders two Agona Assemblies to pay contractor

The Agona Swedru Circuit Court has ordered Agona West Municipal and Agona East District assemblies to pay 101,058 Ghana Cedis retention money they owed the contractor.

The court presided over by Justice N.K. Osam, High Court Judge, who also sat as an additional Circuit Court Judge ruled in a case in which Mr. Eric Siripi, Managing Director of Saka Ampoma Enterprise filed summons at the court to demand payment of retention money on projects he executed for the assemblies between 2008 and 2010.

The two assemblies failed to file appearance at the court and judgment was therefore entered in favour of the plaintiff.

Mr. Siripi filed the suit in September, 2013 at Agona Swedru Circuit and High Courts respectively to demand payment of five per cent retention of the contracts sum.

The court ruled that the interest on the money be run until date of payment of the debts.

The Agona East District Assembly awarded contracts to Saka Ampoma Enterprise to construct three-classroom blocks each at Agona Asafo Zion and Agona Kwanyako Anglican basic schools in 2008 and 2009.

In 2008, the Agona West Municipal Assembly also awarded a construction of Meat Shop and Clinic at Artisan Village and Mandela market at Agona Swedru to the same contractor but the two assemblies failed to pay him for the retention money.
