The Member of Parliament (MP) for Manhyia South, Nana Agyei Baffour Awuah, has claimed that Article 146 of the 1992 Constitution was not used by the government of former President Nana Addo Dankwa Akufo-Addo to remove former chairperson of the Electoral Commission of Ghana, Charlotte Osei.
According to him, Baffour Awuah, the former EC boss was the cause of her own removal.
He claimed that Charlotte Osei, who he said had a very good relationship with Akufo-Addo, wanted him to remove her deputy.
He added that deputies then joined forces against her, which eventually led to her removal.
“Nobody touched Article 146; there is a misconception out there. Our mother Charlotte Osei brought her removal on herself. She wanted her deputies removed.
“She had a very good relationship with Nana Addo. And she thought that she could leverage that relationship to get her deputies out,” he said in a recent interview on Adom FM.
The Manhyia South legislator added, “But the deputies turned on her with all that they know, including the procurement officer.”
Baffour Awuah made these claims while commenting on a petition filed for the removal of the current EC boss, Jean Mensa.
A staff member of the Commission, Joseph Blankson Adumadzie, petitioned President John Dramani Mahama to begin processes for the removal of EC Chairperson Jean Mensa and her two deputies, Dr Bossman Eric Asare and Samuel Tettey, over alleged misconduct.
In a report by citinewsroom.com on Monday, November 24, 2025, Adumadzie confirmed that the petition was filed in accordance with Article 146 of the 1992 Constitution, which outlines procedures for the removal of heads of independent constitutional bodies.

He declined to give full details of the petition, citing legal restrictions, but disclosed that it is based on 12 counts of stated misbehaviour.
The allegations include cronyism, abuse of office, and gross incompetence.
Adumadzie also argued that the conduct of the three senior officials has weakened public confidence in the EC and poses a threat to the integrity and independence of Ghana’s electoral process.
He stated that his action is motivated by a desire to safeguard the Constitution and promote accountable governance, stressing the importance of protecting the dignity of the Electoral Commission as a crucial institution in the country’s democratic framework.
Adumadzie further called on President Mahama to fulfil his constitutional obligations by referring the petition to the Chief Justice for the establishment of a prima facie case, as required under Article 146.
