President John Dramani Mahama has disclosed that a petition seeking the removal of Supreme Court Justice Yonny Kulendi did not establish a prima facie case.

According to an X post shared on Tuesday, December 16, by the Minister of State in charge of Government Communications, Felix Kwakye Ofosu, the decision was taken upon advice of the Chief Justice Paul Baffoe-Bonnie, who reviewed the petition and concluded that it did not meet the threshold required by Article 146 of the 1992 Constitution.

“The Chief Justice wrote to the President, indicating that the petition did not disclose a prima facie case. The President has communicated what the Chief Justice said to the petitioner," he wrote.

The petition, filed by Daniel Marfo Ofori-Atta on October 2, 2025, called for Justice Kulendi’s removal from office.

This followed a similar petition he submitted to the Criminal Investigation Department (CID) of the Ghana Police Service, requesting an investigation into Justice Kulendi and his cousin, Richard Jakpa, over allegations of attempting to interfere with the administration of justice.

The petition stems from the high-profile trial in the case of the Republic versus Cassiel Ato Forson and 2 others, in which Jakpa, currently the director of operations at the National Security Secretariat, was the third accused.

Ofori-Atta alleged that Justice Kulendi attempted to obstruct justice, violating the code of conduct expected of a Supreme Court judge.

He claimed that these actions constitute misbehaviour, rendering Justice Kulendi unfit to hold office.
