Martin Amidu has warned against using Ghana’s criminal justice system to pursue political opponents while ignoring other people connected to corruption cases.

The former Attorney General and Special Prosecutor said criminal offences must be treated as such regardless of the political interests of an incumbent government.

“Crime must be treated as crime instead of turning the hallowed criminal justice system which was bequeathed to Ghanaians over generations into an instrument of political vendetta,” Amidu said in an open letter.

His comments form part of his criticism of how the Asante Kwaku Berko-AKSA bribery case is being handled in Ghana after Berko was convicted in the United States on August 6, 2026.

Amidu argued that state institutions should not selectively prosecute corruption and other offences of dishonesty against political opponents in an attempt to gain electoral advantage.

He said such an approach would undermine constitutionalism, the rule of law and democracy.

“That is not a path to cementing constitutionalism, the rule of law and democracy in the Ghanaian society,” he said.

According to Amidu, selective use of state institutions could instead deepen political tensions and weaken national unity.

He called for governments and state institutions to serve citizens fairly and impartially, regardless of political considerations.

“Governments and state institutions must serve the electorate fairly and impartially,” he said.

Amidu further cautioned against allowing state institutions to become instruments of incumbent governments, stressing that they are funded by the public and should operate in the interest of Ghana.

“State institutions must never become gangsters of incumbent governments paid from the public purse operating against the interest of the Republic of Ghana,” he added.
