High Court Throws Out Chief Justice Torkornoo’s Judicial Review Bid

The High Court’s Human Rights Division 1 has rejected suspended Chief Justice Gertrude Torkornoo’s judicial review application, declaring it an abuse of court procedures and outside the court’s jurisdiction.

Justice Torkornoo, facing impeachment under Article 146 of the 1992 Constitution, had sought a certiorari order to stop the process, claiming it infringed on her fundamental rights. Her application also contested the constitutionality of the impeachment procedure itself.

This came after the Supreme Court dismissed three prior injunction requests aimed at suspending the impeachment until constitutional provisions on removing a Chief Justice were clarified.

The High Court ruled that it had no authority to interfere in the matter and stated that the application misused the judicial system.

Meanwhile, the impeachment proceedings against Chief Justice Torkornoo continue.
