Yaw Asante Agyekum, who was sentenced to 35 years in prison in 2010, was cleared and dismissed by the Court of Appeal, as was infamous armed robber Ataa Ayi, who was incarcerated for 160 years.
He was, however, remanded in 2002. Agyekum, who had already spent 23 years in prison and served 15 of his term, was convicted of conspiracy to commit murder.
He was claimed to be a mechanic for the infamous armed robber Atta Ayi, whose group terrorised Accra's streets in the late 1990s and early 2000s.
Ataa Ayi and his crew were found guilty of seven charges of robbery. Agyekum, on the other hand, filed an appeal with his lawyers, claiming that the prosecution could not link their client to any of the offenses.
On appeal, the court of appeals agreed with Agyekum's lawyers, who had no legal assistance at the time of his conviction, and overturned the conviction.
The three-member panel of Justice Aboagye Tanoh, Justice Stephen Oppong, and Justice Janapare Bartels Kodwo concluded that the prosecution failed to "provide sufficient evidence to warrant conviction and sentence."
