Due to a continuing business conflict with HODA Holdings and police officers' noncompliance with a legitimate court order, the Inspector General of Police (IGP), Dr. George Akuffo Dampare, has filed a petition against the Mohinani Group, the owners of Polytanks Ghana Limited.
According to Polytanks Ghana Limited, which is situated at the Motorway Industrial Estate, Baatsona, Spintex Road in Accra, armed land guards have surrounded its property, hampering operations and making it impossible to enforce a court order.
Some of its biggest customers have been impacted by this interruption, including GB Foods, Nestlé, Unilever, Fan Milk, and Voltic.
Kwabena Duffuor, a former finance minister and former governor of the Bank of Ghana (BoG), is in charge of HODA Holdings Ltd, held by Unicredit Ghana Limited.
A petition submitted to the IGP by the Mohinani Group claims that, "despite our valid 11-year Joint Collaboration Agreement signed in 2021, court bailiffs, accompanied by armed police officers from the Greater Accra Regional Command, forcibly executed a Certificate of Possession on our leased premises at West African Packaging and Printing Limited (WAPP) on January 28, 2025."
The petition goes on to say, "This forced closure has resulted in daily financial losses exceeding GHS 1 million, the displacement of 150 direct workers, the potential loss of 3,000 indirect jobs, an inability to fulfill contractual obligations to major clients (Unilever, Fan Milk, Nestlé, GB Foods, Voltic), and inaccessibility to substantial investments in machinery and equipment."
The petition, submitted by the Mohinani Group's Executive Director, is headed Police Non-Compliance with Court Order in WAPP-HODA Holdings Commercial Dispute and was dated February 18, 2025.
It emphasizes that "our motion to suspend the execution was granted by the Commercial Division of the Accra High Court on January 31, 2025." The document further states that on February 6, 2025, "the order was forwarded to the Regional Commander by the Director-General of Legal and Prosecutions (DCOP Benjamin Osei Addae)." But for unknown reasons, the Regional Commander has not followed through on this court decision, therefore armed forces are still unlawfully occupying our property.
The petition bemoans the fact that "we have tried, without success, to engage both HODA Holdings and police authorities to resolve this matter amicably." This non-compliance jeopardizes Ghana's manufacturing sector's financial stability in addition to undermining judicial authority.
In light of this, the Mohinani Group has demanded prompt action, saying, "We urgently request your immediate intervention to direct the Greater Accra Regional Commander to comply with the court's suspension order, withdraw all armed individuals from the WAPP premises, facilitate our lawful re-entry to resume operations, and investigate the circumstances leading to this non-compliance with a valid court order."
The company emphasised its commitment to Ghana’s industrial sector, saying, “We have invested over US$3 million in this venture since 2021 and remain committed to our role in Ghana’s industrial development. We trust your commitment to upholding the rule of law and protecting lawful business operations.”
