Dr Essien you have written a nice prose but I do not get the point of your posting. Like others, I do not understand why you or anyone would assume there is going to be potential calamity of mayhem and violence and we must ignore the notion of Justice as the natural road to peace. I guess you and all in Ghana who has been on this "Peace Train" assume that State institutions in Ghana charged to maintain "Law and Order" are incapable of their duties? Who will cause mayhem if their side looses? NDC or NPP? We must avoid coded messaging as it goes without saying that Ghanaians want peace and tranquility.
Our Coat of Arms says Freedom and Justice. It does not say Peace , Freedom and Justice . It is assumed that a free people living in a system that fosters Justice will promote peaceful existence and development. Please do not get me wrong, peace and stability is a necessary condition for economic and social growth but a perception of justice must be supreme. And that is derived from our Constitution and laws. Going to court to seek justice is a mark a free people determine to ensure the rule of law in our young democracy. Why then are some people apprehensive? This petition has done some good by exposing the sham of our electoral processes and systems. The next election may be better to avoid another petition ordeal for the country. The key protagonists have all said they will accept the SC verdict so there is no need for the elite of our society to continue to remind us that peace is important.
Those of us lucky to have secured some comfortable existence living outside the country we love must share our knowledge and thoughts on this medium on how our folks can solve the endemic and systemic official corruption in the looting of national assets, broken down and sub standard educational system ( are you satisfied) youth unemployment, affordable food and water, rural development to slow unsustainable urbanization, and prevention of communicable diseases.
Ghana will be fine after August 29 even if some party looses their case. Let us change the conversation to issues that will make a difference in our country folks lives. That is when God will shower his blessings on Ghana

I want to add my voice to those who say that Ghana will not burn on or after 29th August. Yes there would be elation and disappointment with some; yes some tempers would flare and some voices would be raised but that is as far that it would go. When these die down there would be sober reflection and our electoral procedures and processes would be reformed.
It is not really a bad thing to call for justice as a means to peace if the ‘justice’ is one that emanates from the interpretation of the Law. The call is only wrong if ‘justice’ means ‘my side should win’. It therefore behoves on those who are enlightened in the Law to educate the masses as to what the essentials of justice are.
Dispensing justice is a process rather than the single decision to be announced on the 29th. It was demonstrated even in how the petition was trialled. Each party had time to present its evidence (both in affidavits and orally); each party had the opportunity to cross-examine witnesses; each party had the opportunity to present a written address and each party presented an oral address and answered clarifications from the bench. Moreover the citizenry had the opportunity of watching the trial in its entirety on television. That side of justice was dispensed to the satisfaction of all.
Now comes the final ruling. In this justice demands that:
1. The court considers all the evidence brought before it;
2. The court does not use technicalities to rule out or throw out some of the evidence irrespective of defects in affidavits, exhibit labelling and categorisation of exhibits;
3. Since all parties had the opportunity to present evidence, the court does not look beyond the evidence brought before it to consider other extraneous issues;
4. That the bench does not substitute its will or sentiments for the Law; and more importantly;
5. The ruling itself is justified and explained in terms of the Law.
I submit that if these essential elements are present, the ruling would be satisfactory to all, disappointment notwithstanding. We have no choice otherwise except for a losing party to consider applying for a review.

Please Dr,you cannot tell the SC what to do and what not to do.Please don't forget the judges know their jobs,they can tell what is a credible evidence, proven beyond any reasonable doubt and evidence that lacks substance.You cannot take technicalities away from this because the petition itself is based on some technicalities otherwise we should not be where we are now.The petition is based on technicalities because Nana Addo lost the élections as declared by the EC and International community but is able to hang on the technical aspect of the constitution.Prez Mahama did not steal any votes from Nana Addo or was Afari Gyan found anywhere padding votes for Mahama.The petitioners made wide allegation of fraud,rigging and vote padding immediately after the results were declared.What did we see in court on the face of the pink sheets?No fraud,no rigging,no vote padding,no intimidation and no fighting.You lost the élections and if you lose the petition,what kind of satisfaction do you want again?Just tell me Dr if you are one of those saying that if Nana Addo is not declared president,then Ghana must burn?Ghana will not burn Dr,the SC will uphold the declaration made by EC's boss Dr Afari Gyan because your evidence is so weak to overturn the declared results.If you think that your own evidence is carrying tons of errors and must not be thrown away,how come do you want the SC to throw some votes away?Have you now seen where justice is taking you to?Thank you.

If this is done and it is explained in the ruling, I believe strongly that the citizens would understand, and with a little support from other state institutions responsible for peace and safety in the country, there will be no violence.
Events in the past where the police has looked away while some supporters of a political party have gone on rampage destroying properties and attacking other people perceived to be political opponents must also be addressed.
When this is done there will be no disturbances after the verdict.

In your view,the EC, essentially made up off several thousands of temporary staff,with different levels of education and training,should not be permitted to make any mistakes,but a small team of high-priced lawyers,forensic accountants,IT geeks,'statisticians', etc, is entitled to come up with CONTRIVED evidence and a flawed analysis,and be allowed to get away with it? Good heavens! What in your views are the "other extraneous issues"? Whatever is contained in the 2,602 pink sheets which were deliberately ignored,perhaps? Or the indisputable fact that this attempt to nullify votes is a well-orchestrated subterfuge to get Akufo to the presidency through the 'backdoor'?

It is the consistent application of justice that brings peace. Peace on the other hand cannot bring justice. The reason why the Israeli / Palestinian issue has been outstanding since the days of Noah without a solution simply because everybody in the matter is focusing on the by-product (peace) instead of the actual product (justice).We have lived in a country which seems to have been conceived in illegality, born in illegality and bred in illegality. We cannot watch unconcerned for this state to die in illegality. We cannot under any circumstances sacrifice justice for peace. If in the process of ensuring justice there comes the need to breach the peace, I will say we should do that. We are all calling on the 9 Sc justices to look into the faces of the 24 million Ghanaians both home and abroad and tell us the true interpretation of our constitution , the laws and procedures laid down for the 2012 election and also tell us who actually won the election. That is all we are asking for. We cannot have an omelette without breaking some eggs. This is an impossibility. Let us live and fight for true and pure justice in our motherland Ghana. That is the only way that our nation can survive and grow from strength to strength. Nobody needs to take up arms to kill his neighbor because of the verdict by the 9 Supreme court justices. It will be recalled that many people including stalwarts of the NPP (Tarzan and co) came out to openly rebuke the petitioners for going to court. So far as they are concerned there was no need to go to court, it would have been better to re-organized the party for the 2016 elections. They have argued that it was for the sake of peace that they (the petitioners) should have taken this course of action.
I believe that such decisions would have been a potential cause of disaster as it will ensure peace in the short run, but not in the future. The decision to go to court to seek justice will lead to at least electoral reforms, thereby ensuring that credible elections are held in the country to avoid any violence as a result of electoral malpractices which is a recipe for civil unrest.
