Throughout your article you have spent your energy huffing and puffing about all that is not the crux of the matter. For example, you adduce reasons to underscore the fact that the Special Prosecutor has prosecutorial discretion. But nowhere has anyone said that he hasn’t got such discretion. Rather, the central issue at the heart of the debate relates to documentary evidence attesting to the prosecutorial powers of the Special Prosecutor. That’s all. You only needed to provide substantiation for this element, to nail the matter, rather than the tangent you went, ending in much ado about nothing!! Are you sure you are a lawyer? Perhaps not a very learned one.

IN MY CANDID OPINION, THE BEST WAY TO DEAL WITH OR SATISFY ARTICLE 88(4) OF THE 1992 CONSTITUTION AND SECTION 4(2) OF THE OSP ACT WAS TO GET THE ATTORNEY GENERAL TO SWEAR IN THE SPECIAL PROSECUTOR AND CONFIRMING THE AUTHORITY TO PROSECUTE UNTO HIM OR HER.
