The Member of Parliament for South Dayi, Rockson-Nelson Dafeamekpor, has stated that the Supreme Court’s decision on the Kpandai parliamentary election does not reinstate Matthew Nyindam as a Member of Parliament.
Speaking on the ruling on Tuesday, December 16, 2025, on JoyNews, he described the decision as ‘very straightforward,’ stressing that the apex court’s order suspending the Electoral Commission’s planned rerun does not alter Nyindam’s current legal status.

According to Dafeamekpor, who is also the Majority Chief Whip, Nyindam remains without a seat in Parliament, explaining that the court’s decision only affects the rerun notice issued by the Electoral Commission and does not amount to a reversal of earlier judicial decisions.
“It is a very straightforward ruling, and there is nothing wrong with this ruling. The Supreme Court is merely saying that upon the final determination of the certiorari application before it, the rerun notice given by Electoral Commission in respect of Kpandai parliamentary elections being suspended, it does not affect Nyindam's position regarding his return to the House.
“He is not an MP. Supreme Court has not annulled or overturned the decision of the High Court,” he said.
About Supreme Court’s ruling:/b>
The Supreme Court, on Tuesday, December 16, ordered the Electoral Commission (EC) to suspend all proceedings and activities related to the Kpandai parliamentary rerun, pending the final determination of a case before the court.
In effect, the apex court’s ruling has put on hold all preparations by the EC to conduct the election, which was slated for December 30, 2025.
Supreme Court suspends Kpandai constituency election re-run
This, per the court’s ruling, will remain in effect until all pending legal issues are fully resolved.
The case has been adjourned to January 13, 2026, to allow for further consideration of the matters raised by the parties.
