Joseph Kpemka's appointment as Deputy BOST MD is unconstitutional – Dr. Kwabena Donkor

Member of Parliament for Pru East, Dr. Kwabena Donkor has criticized the appointment of Joseph Dindiok Kpemka as Deputy Managing Director of Bulk Energy Storage and Transportation Limited Company (BOST).

The former Power Minister argues that it is unconstitutional for the president to appoint a former Deputy Attorney-General to a limited liability company.

In an interview with Accra-based Citi FM, Dr. Kwabena Donkor explained that, “BOST is a limited liability company and there is a procedure for appointing officers. Because it is a limited liability company, appointments must be governed by the Companies Act (992). The Presidency has no business appointing CEOs, Deputy MDs or senior officers to any limited liability company.

“There is also the SIGA Act which also does not give the Presidency any appointing powers for limited liability companies."

“There is a procedure and as a people and as a nation, we must learn to respect the law, particularly coming from the Presidency. I have a lot of respect for the President but the Presidency is getting it totally wrong,” the lawmaker said.

President Nana Addo Dankwa Akufo-Addo on May 17, 2024 appointed Joseph Dindiok Kpemka, a former Deputy Attorney-General and Minister for Justice, as the Deputy Managing Director of the Bulk Energy Storage and Transportation Limited Company (BOST).

The appointment was contained in a letter issued by the Executive Secretary to the President, Nana Bediatuo Asante and copied to the Minister for Energy, Dr. Matthew Opoku Prempeh.

In the said letter, the Minister was directed to regularize the appointment of Dindiok Kpemka in accordance with the Companies Act, 2019 (Act 929).
