Aqua Safari dragged to court over debt

Aqua Safari Resort, a restaurant and resort services operator, has been dragged to the Ada Magistrate Court by a restaurant owner, over some unpaid debts, allegedly owed her.

Adiza Ackwerh, the restaurant owner in a writ of summon dated 22nd September 2016, claimed that she entered into a contract agreement with the defendants, Samuel Afari Dartey, Gerhard Peter Urspringer and Seth Annan on 12 August, 2015 to supply 80 packs of food to workers of Aqua Safari on a daily basis which initially began on 30th July, 2015.

According to her the mode of payment under the contract was monthly with an amount per pack fixed at GH¢4.00.

However, she said the defendants unilaterally terminated the contract on 8th August, 2016 without any notice to her and as a result, some materials she bought prior to the termination for the preparation of the food got wasted whilst the perishable items got spoilt.

Ms. Ackwerh, mentioned that 12 bags of rice, two (2) sacks of beans, four (4) packs of spaghetti, one gallon of red oil, a pile of firewood and five (5) packs of polythene all pegged at GH¢ 5, 510.00, went to waste over the action.

Also, about GH¢4, 380. 00 worth of perishable items including half sack of onions, fresh and smoked fishes as well as tomatoes, went bad few days after the termination.

Adding the totals of the wasted and spoilt items, Aqua Safari Resort allegedly owes the plaintiff about GH¢9, 890.

Upon making plain to the defendants and requesting a refund for the items, the plaintiff in the writ of summon disclosed that the defendants have refused to pay the cost though, they (defendants) asked the plaintiff to appear for settlement.

The plaintiff is therefore praying the court to compel the defendants to pay the cost incurred as a result of their action, since it has seriously affected her finances and her creditors are after her for their money.
