Home - Anyenini weighs defence arguments in Angela Adjei Boateng's no-case submission

pic 80281232 Newsfile host Samson Lardy Anyenini has examined the prosecution’s evidence against Angela Adjei Boateng, the wife of former National Signals Bureau Director-General Kwabena Adu-Boahene, highlighting the need to establish her individual involvement in the alleged offences.

Anyenini said the fact that Angela was married to Adu-Boahene or had corporate links to companies mentioned in the case did not, on its own, establish criminal liability.

He made the comments while discussing the defence’s 142-page submission of no case to answer, which challenges the prosecution’s evidence and argues that the charges against Angela have not been sufficiently established.

“Marriage is not conspiracy. Directorship is not proof of criminal intent,” Anyenini said.

He noted that the prosecution would have to demonstrate, through evidence, that Angela knowingly participated in the alleged offences rather than rely solely on her relationship with Adu-Boahene or her position in a company.

Anyenini also examined the defence’s challenge to the prosecution’s claims concerning luxury houses, vehicles and other properties allegedly acquired with funds said to have been stolen.

"Owning expensive property may attract the attention of law enforcement, but it does not without more prove that stolen money paid for those properties," he said.

The defence has questioned whether the prosecution has sufficiently linked the properties identified by the Attorney-General to the alleged stolen funds.

Anyenini stressed that the prosecution must establish the criminal responsibility of each accused person individually, while recognising the right of the accused to challenge the allegations.

"I equally defend the accused person's right to challenge the allegations and insist that the state meet its burden," he said. Source: mynewsgh.com
