SC nullifies findings of Judgement Debt Commissioner in 2 cases

The Supreme Court has nullified the findings of the sole Judgment Debt Commissioner in relation to two cases.

The sole Commissioner in his findings indicted the judges who handled the Alfred Agbesi Woyome vs AG & ors and Sky Consult vs Ghana Post cases for failing to follow due diligence in determining the matter.

The Commission also sought to review and question the decisions of the judges in both cases.

But the Supreme Court says the Commissioner’s finding was unconstitutional because the decisions of a court cannot be subjected to an administrative review.

According to the court, the judiciary is self-disciplining hence outside interference cannot be countenanced.

The seven-member Supreme Court panel chaired by Chief Justice Sophia Akuffo was delivering judgment in a case brought by a private citizen, Claude Oppong, who believes the Commission exceeded its jurisdiction and violated the judicial process by looking into the two cases.
