Plaintiff awarded GHC 18,000 for damages year after he dies

A plaintiff in a case against Ecobank Ghana at an Accra High Court has had the honor of a court ruling in his favor but unfortunately is not alive to enjoy the proceeds of his suit.

Salia Adams of Selemok Ghana limited sued Ecobank for an unauthorized transaction that occurred in its account through online banking.

Represented by Lawyer Lamtiig Apanga, Salia Adams filed a suit alleging that the bank transferred money from its account between 22, 2014 and about December 24, 2014 an amount of 8000 dollars without its authorization.

Though filed in 2014, the case was in court for about four years till the plaintiff was asked to testify in 2018. Unfortunately, Salia Adams passed on few weeks after testifying in the case.

A year exactly on, an Accra High Court in charge of the said case ordered the bank; Ecobank to pay an amount of GHC10,000 as damages for negligence with an interest at the prevailing bank lending rate from December 22,2014 till date of final payment.

The judgment was on June 26th 2019 exactly a year and the anniversary of the death of the plaintiff Salia Adams of Salemok Ghana limited.

The court, presided over by justice Ackaah-Boafo on reading the findings of fact and evaluation said, “the end result is that I find the bank to have been negligent in making the transfer of funds without notification to the plaintiff.”

He therefore concluded that based on the evidence presented to the court, the plaintiff be granted its writ of summons and also awarded an amount of GHC10, 000 as damages for negligence.

An additional amount of GHC 8000 was awarded the plaintiff for his ability to provide evidence to prove his claim.

In total, Mr. Adams has an amount of GHC 18,000 awarded to him by the court.
