The Deputy Attorney General and Minister of Justice, Dr Justice Srem Sai, has reportedly said that embattled former Director-General of the National Signals Bureau (NSB), Kwabena Adu Boahene, who is currently being prosecuted for alleged misappropriation of state funds, did not declare his assets.

Dr Srem Sai, according to GHOne TV, made this disclosure during court proceedings on Wednesday, June 11, 2025.

He reportedly told the court that the former NSB boss did not declare his assets as required by law.

Article 286 of the 1992 Constitution of Ghana mandates public officeholders to complete and submit Assets Declaration forms to the Auditor-General's office upon resumption of office.

“(1) A person who holds a public office mentioned in clause (5) of this article shall submit to the Auditor-General a written declaration of all property or assets owned by, or liabilities owed by, him whether directly or indirectly – (a) within three months after the coming into force of this Constitution or before taking office, as the case may be, (b) at the end of every four years; and (c) at the end of his term of office.

“(2) Failure to declare or knowingly making false declaration shall be a contravention of this Constitution and shall be dealt with in accordance with Article 287 of this Constitution,” part of the article reads.

Section 3 of the article further states, “The declaration made under clause (1) of this article shall, on demand, be produced in evidence – (a) before a court of competent jurisdiction; or (b) before a commission of inquiry appointed under Article 278 of this Constitution; or (c) before an investigator appointed by the Commissioner for Human Rights and Administrative Justice.”

Article 287 mandates the Commissioner for Human Rights and Administrative Justice to take actions it deems appropriate against public officers who fail to declare their assets.

Meanwhile, investigations by the Economic and Organised Crime Office (EOCO) and the Attorney General's office have uncovered a number of properties allegedly acquired with embezzled state funds by Adu-Boahene and his wife.

Below is a breakdown of the properties and their estimated values under the couple's names:

No. 2 Stream Part Drive, Mayfair Estates, La, Accra – estimated at $1,000,000 (valued at GH¢15,000,000);

No. 6 Edith Avenue, Mayfair Estates, La, Accra;

No. 7 Edith Avenue, Mayfair Estates, La, Accra – estimated at $200,000;

No. 8 Edith Avenue, Mayfair Estates, La, Accra – estimated at $97,815;

No. 9 Edith Avenue, Mayfair Estates, La, Accra – valued at $270,000;

No. 10 Edith Avenue, Mayfair Estates, La, Accra – valued at $150,000; Additionally, an initial cash deposit of $500,000 was made to purchase five houses;

Vertex Properties at Oyarifa Gated Estate Development – this consists of 27 houses, each valued at an estimated $295,000 (GH¢127,000,000 in total);

Two properties in London.
