The Majority Chief Whip, Rockson-Nelson Dafeamekpor, has said that former Chief Justice, Justice Gertrude Araba Esaaba Sackey Torkornoo, has the constitutional right to challenge her removal from office in court.
According to citinewsroom.com report on September 2, 2025, Dafeamekpor argued that the legal process does not end with the President’s decision.
“When Charlotte Osei [former Electoral Commission chairperson] was removed under Article 146 of the 1992 Constitution, Kweku Baako renowned journalist went to the Supreme Court to challenge it. Isn’t it? The Chief Justice can go to the Supreme Court to challenge the findings and recommendations of the Committee, which she has the right,” he stated.
The Majority Chief Whip stressed that Justice Torkornoo, like any public officer affected by such proceedings, can still seek judicial review.
Here is why Chief Justice Torkonoo was removed
“Nobody should think that this is the end. Kweku Baako didn’t find favour with the court. It doesn’t mean that the findings of the committee cannot be challenged in the Supreme Court; it can,” he indicated.
Justice Torkornoo was removed from office on Monday, September 1, 2025, after President John Dramani Mahama acted on the recommendations of the committee set up under Article 146(6) of the Constitution to probe three petitions for the removal of Justice Torkornoo.
The Committee, which was tasked to investigate petitions brought by Daniel Ofori, Ayamga Akolgo and Shining Stars, concluded its work and submitted their recommendation to the President, leading to her removal.
