I agree that this writer needs to go back and learn simple, proper, comphrensible English. It baffles me to see how most supposedly high-caliber Ghanaian journalist try to over-impress readers with antique methods of writing. ... read full comment
I agree that this writer needs to go back and learn simple, proper, comphrensible English. It baffles me to see how most supposedly high-caliber Ghanaian journalist try to over-impress readers with antique methods of writing. I guess I shouldn't be too surprised because that may be how students are still being taught in our prestigious GIJ-- I once tore up a draf letter which was written by an instructor at the institute for a friend. Why? because I couldn't make sense of it, and neither could my friend. Writing simple and understandable English does not potray inferiority, it shows confidence and mastery of the language! C'mon guys, we can do better than this!

When cases get over politicized, they not only make things very difficult for the courts, but also undermine the confidence in and integrity of the entire legal system.
The case is getting too complicated, and we run the risk of overpoliticizing it to the point where it may become judicially unmanageable. In some legal systems, there are doctrines which, though not fully developed or used in Ghana, are not precluded from being considered by our courts. One such doctrine is the political question doctrine, applicable in cases where, among others, any of the following circumstances exists:
lack of judicially discoverable and manageable standards to resolve them;
impossibility for a court's independent resolution without exhibiting lack of respect for a coordinate branch of the government;
impossibility of deciding the issue without an initial policy decision, which is beyond the discretion of the court;
unusual need for unquestioning adherence to a political decision already made;
potentiality of embarrassment from multifarious pronouncements by various departments on one question.
If we are not careful with our comments, the case may become so politicized that the Court
may lack the tools to resolve it with the objectivity needed to keep its decisions beyond reproach.
Coupled with the political question doctrine, there is the question of whether mootness is a viable issue at this point where President Mahama has already been inaugurated. Although cases may not be moot if they raise questions that are capable of repetition and yet evading review, it is not clear how this principle will play out in this case where, with the proper pleading, the inauguration could have been enjoined, pending the accelerated handling of the case on the merits.
As you can see, these and many other difficult legal issues would be considered by the Court. If we keep adding our negative partisan and ultra-divisive comments the way we have been doing, we may complicate matters beyond manageability. Let's stop the bickering and leave the Judiciary to do its work and produce a decision that would be appreciably convincing to all sides.

I see no reason why citizens who exercise their constitutional rights are being asked by other citizens to shut up. That is exactly what the writer of this piece is trying to convey here. The legal team of Nana Akufo-Addo have every right in the books to ask any judge to recuse him or herself if the sense any iota of conflict of interest. That is pure and simple. Why are we so blind folded by partisan politics that we can't even reason? What if the shoe was on the other foot? Matter of fact, I believe it will serve all of us well if the honorable justice voluntarily recuse's himself from the bench in matters regarding this case before the Supreme. It will be an honorable thing to do.

As reflected in my comments last week, it makes sense for judge Atuguba to recuse himself voluntarily. As further noted in those comments, recusal should have no impact on the implicated issue of joining the NDC because, as an indispensable party without whose participation the case would be impossible to resolve completely, basic rules of civil procedure would have favored dismissal of the action (at least without prejudice) if the defendants had moved according, and that, where no such move was made, the justices are authorized to allow the joinder or an intervention.
The problem which prompted me to issue today's remarks is the over politicized comments on the recusal issue. In the last week's comments, I referenced the Sallah case and how the justices noted that if the principle that a judge should be recused from a case in which he/she has financial or familial interests is followed to its literal limits, there would be no single judge that can sit on a case in Ghana, as every judge is related to somebody who is, in turn, related to somebody. If you look at some of the comments ensuing from the recusal petition, you would see how the issue has been inflated and over politicized beyond its initial confinement to Judge Atuguba. The need to avoid getting embroiled on some of these issues and their potential negative impact on the Court's ultimate decision on the merits of the case were what prompted my plea that we should eschew overpoliticization of the case. Please bear with me: let's constrain ourselves with objectivity and neutrality to enable the Court to do its work soundly, based solely on the law.
