Law and order in all seriousness is the forefather in every democracy, that tribal political resumes cannot circumvent by native intelligence or otherwise. What is going on in Ghana is judicial tyranny mixed up with judicial activism. This is a very dangerous trend for the nation, and, all Ghanaians must resist such a trend. Judges are supposed to interpret the law, and, not to provide political guidance as we have seen of the Atubuga bench.
Truly, as a branch of the government, Judges (the courts] make policy, but, such policy making role is usually delegated to them. What we have seen thus far of the Atubuga bench is judicial tyranny aimed at crushing expression in Ghana with the threat of contempt in favor of a certain political direction. This has rendered politicians and the media almost muted. Everyone has shut up to put up with it.
At the time same, that bench via Atubuga reserved to itself the right to make political commentary from the bench to the extent of asserting that the court would not allow certain political trends to take place in Ghana. Who gave Atubuga and the rest on that bench such right and power? These nine justices [and for that matter no such committee] could claim to be the wisest people in Ghana.
If Ghanaians should protect against anything at all, that must include the right to free expression. Without freedom of expression, any claim to the democratic process would only be a sham. And if Ghanaians cannot criticize the courts, what other governmental institution can they criticize? The military? The Presidency? The Police Force?
In democracies, Judges are supposed to be level-headed, thoughtful, temperate, adult-like and deaf[immune to daily chatter and even irritating comments]people. The Atubuga bench appears to be a bunch of thin skin demigods carrying walkie-talkies and political whips around to let it lose on any source of scratch. This is proof that Africans can never practice democracy the way it is practiced in the West, because, in Ghana as in other African societies, "every little big man" assumes the characteristics of the "chief." This is exactly what has been exhibited by Atubuga and his bench. The warning here from Atubuga is that the Justices know it all and they cannot be wrong, and, woe betide those who would resist, challenge, or even doubt the court. This is judicial tyranny and Ghanaians must resist it.

Had Ghanaians had the boldness to draw Afari-Gyan's attention and to stop him, there might not have been the alleged elections fraud, alleged compromise and cover-up attempts; and so there might not have been the ongoing court issues that are weighing on Ghana and Ghanaians.
WE MUST STOP HIM/THEM FROM BEHAVING AUTOCRATICALLY BEFORE IT IS LATE.

The Supreme Court judges are removing gradually a canker from our society. For many years we have lost our sense of decency. People throw insults at their president as if he is a coup plotter. MAHAMA did not get to the flag staff house because he made a coup. Yet elderly people sit back and watch bad mouthed unemployed bastards hurl insults at him. As the court said last week these bad talkers have even rendered the security people ineffective. So it appears the Supreme Court is the only institution left to kick ass. And I encourage them to kick it harder to that evil Ghanaians including the writer of the article are forced to learn some decency in the society

The thing so many people forget about Freedom of Speech is that you have to use it responsibly. You have to allow for repercussions. Freedom of speech doesn't absolve you from that responsibility. It certainly doesn't exempt you from prosecution if you are in breach of it.
Sadly this columnist,a typical example of a little learning is a dangerous thing has got all wrong.He thinks a court order can be flouted and use freedom of speech as a shield for protection against prosecution.Indeed freedom of speech has limit and rightly so because without that society will become lawless and descend into chaos.

Dear Mr. Owusu Ansah, thank you very much for your perfect analysis of the mind of the Supreme Court Judges. It beats my mind why supposedly educated Legonians (graduate of the University of Legon and Kwame Nkrumah University, Cape Coast University) cannot see the danger in the discharge of the so called justice by the supreme court judges. I guess those of us who have lived in a true democratic rule see things differently. I say this to mean that the democratic rule that we have lived in - the specifically in the West such as the U.S is quite different from that of Ghana. So I think that Ghana should not say that they are practicing democracy. How can a judge who says that I have insulted him and or demeaned his office adjudicate a case that affect him personally or his office. This is called conflict of interest. So democratically those judges who claim they have been offended or their office has been offended should have excused themselves for others to judge the case. In the case of the those that faced the judges had already been presumed guilty. How could they then democratically get impartial judgment. Please whoever is reading this comment of mine should not take my argument that I condone the behavior of the Sir. John and others. Not at all. Their utterances were foolish. But in a democratically governance when people say anything that breach the law, it the Justice department shat investigate and if their utterances deem to be an offence to the state then the Attorney general office will then bring charges to such a person to come to the court to defend him/herself. That is the rule of law that some of live under that we call democracy. What is happening in the Supreme Court of Ghana is not democracy. We should give it another name then we know how to conduct ourselves when we visit or come back home to live. As it is now some of us are afraid to come and live under such a rule of law. God saves Ghana.

I think your understanding of the law is different from the rest of us.In contempt of court law whether here or abroad, is governed by com mom law and statute.There is no conflict of interest with you go against a court order.That court will deal with you.The English court imposed a heavy fine on the mirror group recently for making a publication against the court order.What happened is that these people breached an order of the court and therefore they were asked to show cause why they should not be punished for the breach.They pleaded guilty to the charge and were punished accordingly.There is nothing strange about that.The law specifically give that right to the court as enshrined under our constitution.They have not given that right to themselves.
