The company should have demanded that the right thing be done from the beginning. If there was any contract at all between the company and the government, it was not considered a contract until it was endorsed by the parliament. So, if parliament had not endorse it before it was abrogated, then the company can not claim judgement debt from the state. Every international contract is not valid unless approved by the parliament. And the don't have a valid contract to claim judgement debt from the state of Ghana.

Supreme Court is the highest court in Ghana, so you either must respect it and pay the money with interest or you must be jailed for stealing.

So, Ghana, YOUR Supreme Court is now using a so called "clause" in your Constitution to overturn judgment debts, forgetting this foundational principle of Contracts Law- which is, two parties who contract presumably with the "meeting of the minds",- one cannot be unjustly enriched at the expense or to the detriment of the other party, who have come to the bargaining table with equal bargaining power, without some sort of restitution?...
Normally, the only cases which results in what the SC is now doing are illegal contracts, contracts by minors, and contracts where there is an unknowingly or knowingly venerable party to that contract( one who is not of sound mind, or educational inequity or what have you); then contracts are NULL and VOID using public policy considerations!
Therefore, if in fact these companies did provide legitimate services which it could be said justly or now unjustly enriched Ghana ( meaning Ghana received some benefits thereof), and this can be proven using evidence, it baffles a reasonable mind why a WHOLE Supreme Court will just use the Constitution to cause these companies to suffer detriment, while Ghana was enriched by their services- I mean a competent court of Law and or Equity should find otherwise? Are the Supreme Court Judges not verse in the basic tenets of Contract Law?
2- If Ghanaian officials are entering into arbitrary contracts with foreign entities where they have been enticed to perform or begin to perform, despite not following the legally complaint contracting rules of the government, do these entities not deserve some restitution for services or goods that they may have provided in good faith, even if an alleged contract is abrogated b/c it was not approved by parliament? Why should one party suffer loss or detriment while the other is enriched? Is the SC saying that these companies provided NO services which benefited Ghana for which they deserve some compensation ( what about principles of bargain for exchange and consideration )?
Who is most to BLAME here? The foreign entities or the Woyomes of the world , or the officials representatives of the Ghanaian government who have been tasked to negotiate in good faith using the people's resources, and have WOEFULLY, negligently, intentionally FAILED by either taking shortcuts, abrogating contracts and taking kickbacks to suit their personal, tribal, and political agenda?

However, if Ghana's Constitution explicitly says if you don't have parliament's approval, then the contract is illegal or invalid, then perhaps they can do what they are doing- however, WHAT IS THE SC, PARLIAMENT, SECURITY AND LAWENFORCEMENT DOING ABOUT OR TO THOSE PERSONS WHO ARE ENDORSING ILLEGAL CONTRACTS, PERHAPS TO TAKE THEIR KICKBACKS, KNOWING THAT THE CONTRACT WILL EVENTUALLY BE INVALIDATED BY THE SC? Isofoton should not suffer a loss because of an omission on the part of GOG or a failure of process between GOG and Parliament of Ghana (POG). GOG and POG are separate entities and would be so in contract law, and Isofoton's contract was with GOG not POP. If GOG on its on recognisance cannot bind the nation in an agreement with a third party, then God help us. Let truth be said.... it too simplistic for the Supreme Court to say that GOG didn't clear the plan/expenditure with it therefore the Nation of Ghana won't pay its due or financial obligation. Morally wrong as it is, it's shameful. We should put our house in order (workings between The Executive and Parliament) and not rather punish our business partners.

Many have been quick to call on President Mahama to order EOCO to expedite action on retrieving monies belonging to the state which were dashed out to Woyome, Waterville and Co. The calls are coming the wake of the ruling in favour of Ghana’s Citizen Vigilante, Gargantuan General Martin Amidu. Some are calling him to reward the Gargantuan General whilst some are even advocating his reinstatement as the substantive minister of justice and Attorney General. But to this time not even a cough have been heard from the president or the presidency regarding this nation wrecking conspiracy which led to the dolling out of such monies to these companies and individual. To many of us who have watched this episode very closely, the doormat reaction of Mahama and his administration is nothing to exclaim about. It is an established fact that the whole NDC administration is deeply complicit in this whole saga. Not just because key figures in the administration are involved but also because they openly and vehemently placed themselves against anyone who raised doubts about the right of these companies and especially Woyome to receive this bulk sum from our poor country. We all still remember how the entire ndc rented press and its communication machinery turned their arsenals against Gargantuan General Amidu and Hon Ken Agyapong when these revelations started. It made it look more like an entire administration conspiring with these folks to rape the nation as the judges rightly mentioned.
What is more intriguing is that, President Mahama has just refused to say a word since Gargantuan General Amidu was handed these two victories in the highest court of our land. Not even a congratulatory message. I find it very funny when people are asking for a reward for the Gargantuan General seeing that even a greeting has not reached his ear from the president. But as I indicated earlier on, I don’t expect the president to utter a word. Because his own vice, H.E Amissah Arthur was the governor of the Bank of Ghana when this monies were approved and paid to The NDC financier, Waterville and Isofoton.
In fact it was vice president Amissah Arthur who was governing the finance of this country and should have known or even knew the details of this unprecedented and unmerited payments. Mr Mahama had full knowledge of all these when he still went ahead to choose Amissah Arthur as his vice presidential candidate. Moreover, big heads within the NDC like Kwabena Duffour, Betty Mould Iddrisu, Barton Oduro and the entire AG inner circle at the time have all been saddled and tightly entangled in this saga. All the lawyers who threw conscience to the dogs and forgot about sanity and even legalities and defended Woyome and his cronies are all big guns within the NDC.
