Mr Otchere Darko, you are 100% right. The Constitution erred. There should be an amendment.
Thanks to Nana, Jake and Dr. Bawumia for exposing this flaw in the Constitution. The first result of 'the test of the Ghanaian Constitution'.
The Constitution erred because maybe and although, the provision of filing a petition by an aggrieved citizen at the supreme court was stated in the Constitution, the writers did not believe, dream of such a situation ever emerging because of the confidence and trust they had in The Almighty Electoral Commission, forgetting that The Electoral Commission is an Institution, a 'legal entity' or 'person', which is impersonated by a fallible human-being.
Who knows whether or not the electoral commission had been manipulating the elections since its creation. Maybe Dr Afari Gyan, the head of the Electoral Commission, sleeps and dreams. "This election would be for NDC and The next election would be for NPP; And because President Atta Mills' premature death and also because one comes from 'heaven', I Dr. Afari Gyan, The Almighty Ghanaian God ,The infallible, will make him the next President of Ghana because I am the omnipotent, the Almighty, Kasapreko, Osagyefo, Kantamanto, Oseadeyo, Kwame Atoapoma, Katakyie, Dr. Afari Gyan.
I, Dr. Afari Gyan, I am nearing my retirement age. I need money to relax and enjoy because I have created 'Presidents in Ghana' from NDC, NDC, NPP,NPP , NDC and another Ndc.

Go through the expense of the court process again wasting more money to get a3675 back. I really need some help -as I feel there is no one on the side of decent good land lords. I have asked the DPS for a freedom of information request on the amounts of money in their accounts for similar situations and money unclaimed. There is alot more to this, but have just given you a basic outlineLisa Laisney

Now that NPP is very busy hacking the EC to pieces, they forget that it was the same EC which handed them victory in 2000 and 2004; and that it would be the same institution which would declear them winners in future, if they are able to win the elections. They are happily dragging the EC's hard won reputation in the gutters. Aren't they setting the tone for future behaviour of other parties should they also win the elections in the future? Going to court, yes, but all this business of their communicators saying all sorts of things about the EC is not the best. The supreme court will still use the results of the elections organise by the "discredited" Electoral Commission to judge the NPP grievance.

My Dear Yaw Amofa, please understand this position.
1.It is not the Electoral Commission, as an institution, which is corrupt but the people who manage it.
2.This petition is a 'shake up test' and a 'test of the Constitution' i.e. whether or not it can guarantee the liberty and Freedom of the citizens.
3. The petition will test the Judiciary, that is to make us know whether the Judges are honest and interprete the LAWS without fear and favor.
4. Dr. Afari Gyan should resign in peace because he created Ex President JJ Rawlings to be president of Ghana. He also created Ex President J.A. kuffour to be The President of Ghana, Late Ex President Atta Mills to be President of Ghana, and now he is trying to create President Mahama to be the next President of Ghana.
4 After the decision by the supreme
Court, the Electoral commission is going to sit up! and any future electoral Commissioner is going to learn his lesson and the lesson would be that he is there as 'a servant of the people and NoT the Lord of the people'.
Besides, The Constitution would be amended to take care of the flaws. And these flaws are:
1. The date for the elections would be changed from December to either October or November, so that any election disputes would be ironed-out before the President-Elect is sworn into office.
2. The President Elect would not be sworn into Office by the same Supreme Court Judges who would be deciding on a petition should there be any of such in the future.
3. Finally, The petition by Nana, Jake and DR. is an eye opener. A test of the Constitution.

Mr Darko, there is the danger of tinkering with the Constitution any time there is a problem. Appointing an interim president is not the best solution because the interim president will also make appointments that will be reversed by the permanent president whenever s/he takes office.
The current position is the best (when the President Elect is sworn in until the Supreme Court decides otherwise). The best solution is for the elections to be held early (October/November) to allow enough time for the Supreme Court to decide on the petition before investiture on January 7. This will require a minor amendment to the Constitution. It is not advisable to set time limit for the SC to hear a petition as well as forcing the EC to hold elections. If the constitution is amended for elections to be held earlier then the EC will work with what is prescribed. The President has no authority to change the constitution. The Executive can present a Bill to parliament to amend the Constitution if it is not the entrenched section. Entrenched section require a referendum before being amended.

Realistically, if the ruling of the supreme court goes in favour of the NPP, there will be no country for Akufo Addo to govern. There will be civil WAR and the judges will be the first casualties. People should stop being naive and wake up. The NPP does not have the monopoly of violence. On the face of the evidence presented by the NPP, all objective lawyers believe they do not have a case. Our only fear is that some judges might try to behave in a bizarre manner. In that case Ghana will BURN.
