Open Chapel - Court Orders

Kumasi (ASH), June 23, - A Kumasi High Court has ordered the opening of the chapel of the Evangelical Presbyterian (EP) Church, Ghana, at Amakom in Kumasi for worship and other activities pending the determination of a suit before it. Giving the order, Miss Justice Rose Owusu said the defendants, EP Church of Ghana, have shown a lackadaisical attitude towards the case which was instituted in 1993. Miss Justice Owusu said the defendants from information received have built their own chapel in which they worship and are, therefore, not anxious to have the case heard. They have also called for several adjournments and frequent changing of counsel. This situation, Miss Justice Owusu said, has, since 1993, prevented the court from starting the case while the plaintiffs are pressing for hearing since they have no place of worship. The plaintiffs are seeking a declaration that the Evangelical Presbyterian Church of Ghana, Amakom, having broken away from the church are not entitled to the possession, use and enjoyment of their assets. They are also seeking perpetual injunction to restrain the defendants from the unlawful and unauthorised use of the name Evangelical Presbyterian Church of Ghana, Amakom, Kumasi which is the name of the plaintiff's church.
